The NSW Environment Protection Authority (EPA) has issued Broula King Joint Venture with a fine of $15,000 for failing to undertake monitoring required by the company’s environment protection licence at its Cowra gold mine.
EPA Regional Director for South and West Gary Whytcross said while the mine may currently be in care and maintenance, the EPA expects that all requirements of the licence will continue to be met.
“The EPA reviewed the company’s Annual Return for the July 2015 to July 2016 period and identified non- compliances with the monitoring requirements,” Mr Whytcross said.
The monitoring related to groundwater monitoring, dust monitoring and monitoring of the volume of storm water discharges from the premises.
“It is also disappointing that the company failed to report the non-compliances with its licence as part of its annual reporting as required.
“The EPA requires licence holders to undertake monitoring to safeguard the environment and community, and will not accept a disregard for these conditions.”
The EPA will monitor the company’s future compliance with its environment protection licence conditions.
Penalty Notices are one of a number of tools the EPA can use to achieve environmental compliance including formal warnings, official cautions, licence conditions, notices and directions and prosecutions.
The EPA takes a range of factors into account before delivering a proportionate regulatory response including the degree of environmental harm, whether or not there are any real or potential health impacts, if the action of the offender was deliberate, compliance history, public interest and best environmental outcomes.
