Theo Giallourakis held a protest in front of Cowra Council chambers on Monday morning, calling for the sacking of Councillor Michael Nobes, who was given a 12-month conditional release order with no conviction at Cowra Local Court earlier this month.
Cr Nobes was charged with common assault and intimidating a female taxi driver in March of this year.
As a result of the non-conviction, Cr Nobes is legally able to remain on Cowra Council.
Mr Giallourakis, who missed out on a spot on Cowra Council at the last election in 2016, said it was an "insult on the institution".
"Sack the councillor who insulted the other councillors and didn't look after the Mayor, that's an insult on the institution," he said.
"This man was given a duty, a responsibility and he's abused that power, it could be a curse, it could be a blessing, he didn't use it as a blessing.
"He insulted you all."
Last week, Cowra Mayor, Councillor Bill West responded to the court's decision, saying Cowra Council contacted the NSW Office of Local Government after they were made aware of the incident.
"As this incident occurred when Cr Nobes was acting in a private capacity, Council had no grounds to take action under the Code of Conduct.
"This is an important point that the community should be aware of.
"The legal advice from Local Government NSW clarified that under the terms of the Local Government Act provisions Cr Nobes is still eligible to serve as a Councillor."
