It is disappointing to see you here again and that you have not undertaken the traffic offenders program
- Magistrate Michael O'Brien
Samuel Lachlan Ingram of Wellington Street was before the court charged with driving with a mid range PCA.
According to police facts around 2.15am on November 25, 2018 police were patrolling Cowra when they stopped Ingram for the purpose of a mobile random breath test.
When asked by police if he had consumed alcohol Ingram said, "I'll be over."
Ingram then returned a positive reading to his breath test, a secondary test conducted at the Cowra Police Station returned a reading of 0.111 grams of alcohol in 210 litres of breath.
Ingram told police he began drinking at 3pm on November 24 and finished at 12am on November 25, consuming 400mls of bourbon.
Ingram's solicitor, Mr song, told the court his client had only planned a short five minute drive on the night and was now feeling the impact of not having a licence.
"With the loss of his licence he is now walking his son to school, which has made him realise the impact that a loss of licence has," he said.
"Before this he would drink to intoxication every weekend, he no longer does this and only drinks at special occasions."
Mr Song also told the court that Ingram had sold the car he was driving on the night, although he did have access to another vehicle.
In sentencing Ingram, Magistrate Michael O'Brien said that to his credit Ingram had plead guilty and their were no aggravating factors to his offending.
"It is disappointing to see you here again and that you have not undertaken the traffic offenders program," he said.
"That program would heighten your awareness of the need not to operate a motor vehicle under the influence, by hearing from the families that have been effected by drink driving."
