John William Gundersen of Logan Street was before the court charged with two counts of stalking and intimidation intending fear and physical harm.
According to police facts around 1.57pm on November 8 Gundersen called his victim from a park outside their residence demanding they come out and speak to him. The victim chose not to, and left the residence.
Around 2.22pm the same day Gundersen called the victim’s mobile leaving a message saying he’d bash the victim’s head in and, “tear your f***’in face off”.
He continued to call the victim’s mobile a number of times throughout the afternoon leaving messages saying the victim was a “whore” and he would kill the victim. Police arrested him around 2.45pm.
Gundersen also threatened to take the head off of his victim’s partner.
In an electronically recorded interview Gundersen admitted to being angry and jealous. He also repeatedly referred to the victim as “my missus” and an offensive term despite acknowledging the relationship was over.
During the interview Gundersen also said he’d be likely to punch the partner of the victim in the mouth if he saw the victim’s new partner again, “cause (sic) that’s what men do”.
Gundersen’s solicitor told the court Gundersen’s actions were done in the heat of the moment and that he was very remorseful of what he had done.
His solicitor also said it was fortunate Gundersen had only made verbal threats.
In sentencing Gundersen, Magistrate Michael O’Brien, said that affairs of the heart were always difficult to deal with but what distinguished one person from another was how they dealt with them.
“Relationships break down, but there is never an excuse to threaten violence or throw words around. Hopefully this matter will cause you to reflect and think on what you will do in the future.”
