Higelin had been charged with low range drink driving at Yass in September returning a reading of 0.077 and had taken part in the Traffic Offenders Program since committing the offence.
He told magistrate Michael O’Brien he had learnt, from the program, that drinking and driving was a “terrible decision”.
In not convicting Higelin, Mr O’Brien said he noted his early plea of guilty and that he had no matters of a similar nature on his record.
“You came to the attention of police virtue of a random breath test as opposed to your manner of driving.
“On that basis I’m going to deal with the matter by not recording a conviction so you’ll be entitled to keep your licence but you will need to enter into a conditional release order which means if you re-offend in the next 12 months you can be brought back before the court.
“You need to make sure there is no alcohol or drug in your system,” Mr O’Brien told Higelin.
