Nicholas James Banks, 20, of Kite Street, plead guilty to driving recklessly and in a dangerous manner. Mr Banks’ solicitor, Mr Song, said his client needed his licence as he was working full time at a property out of town.
“There were minimal people at risk,” Mr Song said.
“It was a brief fishtail.”
In sentencing, Magistrate Michael O’Brien said the Traffic Offenders Program had given Mr Banks an insight into what can happen when people drive in a dangerous manner.
“Having a licence is a privilege, not a right,” Magistrate O’Brien said.
“You have taken steps to address these matters. Look after your licence, don’t put it in jeopardy.”
Magistrate O’Brien sentenced Mr Banks to a conditional release order without conviction for 12 months.
According to the police facts, about 5.35pm on January 3, 2018, police were patrolling the Mid Lachlan Highway and approaching the traffic lights at the intersection of Kendal Street and Lachlan Street.
Police then saw a Ford Falcon sedan travelling at an estimated 40km/h. The vehicle turned rapidly to its left upon entry to Kendal Street. At this time, police say the rear of the vehicle had slewed to its right, then to the left, in a fishtail motion. Police also state the car ran a red light.
Police then pulled over Mr Banks, who admitted his actions were “a bit silly”. In relation to the traffic lights, Mr Banks stated they were orange.
Police conducted a breath test, which returned negative. Police say there was a high potential of danger to himself, other pedestrians and vehicles.
